PEEL ASSOCIATION FOOTBALL CLUB
RULES AND CONSTITUTION
1. NAME.
The name of the club shall be ‘Peel Association Football Club’.
2. OBJECTS.
The objects of the club shall be to provide the members with facilities for playing Association Football, to provide a Club House for members, and to promote social activities for members and their properly invited guests.
The Officers of the Club will strive to ensure Members adhere to the clauses of the Football Association’s Code of Conduct, which includes equal opportunities, anti-discrimination and Child Protection policies.
3. RELATIONSHIP WITH THE I.O.M.F.A.
This club accepts the rules and bye-laws of the Isle of Man Football Association, such rules to be binding upon all the members.
4. CONSTITUTION.
The Club shall consist of a Patron, Honorary Life Members, President, Full Members (both local and non-resident), Junior Members (under 18 on 1st September) and Temporary members.
TEMPORARY MEMBERS
a) All members of Association Football Clubs and all other sporting Clubs and Associations for the period during which the Clubs or Associations of which they are members are attending and competing in matches or Festivals run by Peel Association Football Club, and for a period of two hours after the conclusion of such matches or Festivals.
b) All persons who act in various capacities of Referees, Referee’s Assistants, Linesmen, Stewards, Umpires and any other official capacity in connection with the games, sports and pastimes in respect of which such matches and Festivals are run.
c) All persons to whom Temporary Membership is extended under a) and b) above shall for the period of their Temporary Membership (which shall be the period during which the matches or Festival are run and for a period of two hours after the conclusion of such matches or Festivals and no longer period) have all the rights and privileges of full membership.
5. OFFICERS AND COMMITTEE.
That the Management of this club be vested in a Committee of up to nine Members (who shall elect their own Chairman) along with a Secretary, Assistant Secretary, Treasurer, Club Steward, and Council Member of the Isle of Man Football Association who all shall have power to vote on any matters at Committee meetings with the exception of team selection. The Patron, President and Life Members shall have the right to attend any Committee meetings and shall have the right to vote on all matters with the exception of Team selection.
A quorum to transact business shall be deemed to be four duly elected members of the committee and/or officials of the Club.
6. ELECTIONS.
That the Officers and Committee be elected by ballot at the Annual General Meeting which shall be held once each year. All nominees must have paid their subscriptions for the previous season. At the Annual Meeting, a Report and Balance Sheet, duly audited, shall be presented by the Treasurer, and the Secretary shall present a General Report of the previous season’s workings. The Council Member of the Isle of Man Football Association and Child Protection Officer shall be elected, an Auditor chosen, and any other business of which fourteen days notice in writing has been given to the Secretary in addition to the Ordinary business. The Team Managers may also be elected at this meeting.
No person shall vote who has not paid his/her previous year’s
subscription.
7. POWERS OF THE COMMITTEE.
a) The Committee shall have such administrative powers as may be necessary for properly carrying out the objects of the club in accordance with these rules, and from time to time may from among their members appoint such sub-committees as they may deem necessary and may co-opt any other member of the club. The Committee shall have the power to propose Honorary Life-Members, to be approved by the members in General Meeting. The Committee shall have the power to deal with any situation not provided for in these rules.
b) If at any time the Club in General Meeting shall pass a resolution authorizing the Committee to borrow money, the Committee shall thereupon be empowered to borrow for the purpose of the Club, such amount of money at such rate of interest and in such manner as shall be specified in such resolution and the Committee may issue Mortgages or Charges, and may thereby charge all or any of the property and funds of the club with payment of the amount borrowed and interest thereon. All members of the club becoming who joined after the passing of such resolution shall be deemed to have assented to the same as if they had voted in favour of such resolution.
8. ELECTION OF MEMBERS.
Nominations for new membership for all categories of membership must be proposed by at least one Member and seconded by at least one other Member of the Club. Except in the case of Temporary Membership notice of all such nominations must be exhibited within the club premises one week before a decision as to election to Membership is made. Within such period of one week any members shall have the right to object to the admission to membership of the person nominated for membership by notice in writing to the Hon. Secretary. Such nominations and objections will be considered and election to membership or refusal of membership decided by the Committee.
9. RESIGNATION OF MEMBERS.
Resignations shall be submitted in writing to the Hon. Secretary. Members failing to pay their season’s subscription prior to 31st July in any year shall be deemed to have lapsed their membership.
10. EXPULSION AND SUSPENSION OF MEMBERS
The Committee shall have power to expel any Member who shall offend against the rules of the Club or whose conduct shall in the opinion of the Committee render him/her unfit for membership of the Club. Before any such member is expelled the Hon. Secretary shall give him/her seven clear days written notice to attend a meeting of the Committee which notice shall contain particulars of the complaints made against him/her. No member shall be expelled without first having an opportunity of appearing before the Committee and answering the complaints made against him/her nor unless at least two-thirds of the Committee then present vote in favour of his expulsion.
The Committee shall also have power to suspend from membership of the Club from such time as the Committee shall decide any member offending against the rules of the Club but whose offence shall not be considered by the Committee to be sufficiently serious to warrant expulsion.
11. SUBSCRIPTIONS.
The Club’s subscriptions shall be fixed at the Annual General Meeting.
12. ATTENDANCE AT COMMITTEE MEETINGS.
Any member of the Committee who fails to attend three consecutive meetings without having a good and sufficient reason for not doing so may cease to have any further office in the Committee at the discretion of a quorum of the remaining Committee/Officers, and the Committee shall have power to co-opt a new member in that person’s stead. Any member co-opted onto the Committee shall have the same voting rights as a Committee member elected at an Annual General Meeting.
13. SPECIAL GENERAL MEETING.
A Special General Meeting may at any time be summoned by the Chairman or Secretary on receipt of a written requisition stating the business for which such meeting is summoned, and signed by not less than ten members who have paid their annual season’s subscriptions.
14. NOTICES OF ANNUAL GENERAL OR SPECIAL MEETINGS.
That all members be circulated with notice of such meeting, along with a copy of the profit and loss statement and balance sheet (if applicable) and Agenda, stating the time, date, place and business of such meeting seven days before such meeting.
15. CHAIR AND VOTING.
At all meetings of the Club, the President or the Committee Chairman shall take the chair. In the absence of such Officers a Chairman shall be appointed by the members present. Every member present shall have one vote upon every motion, and in the case of equality of votes, the Chairman of the meeting shall have a second or casting vote.
16. FINANCIAL YEAR.
The accounts of the club shall be made up to the 31st day of May each year and
a) audited by an Accountant or an approved person, or
b) examined by an independent person (an ‘examiner’) who is an Accountant or an approved person
and shall be presented by the Hon. Treasurer at the next available Annual General Meeting. A copy of the Accounts shall be sent to each Full Member with notice of the Annual General Meeting.
17. MINUTES
The Committee shall maintain a complete record of the affairs of the Club, including minutes of all meetings and complete playing records of its teams.
18. COLOURS.
All members playing in matches shall wear the Club Colours, which shall be red and white striped shirts, black shorts and red socks with white trim. In the case of a colour clash, the second/change strip shall be worn, which shall be selected at the start of each season at the discretion of the Committee.
19. ALTERATION OF RULES.
The foregoing rules shall not be altered or amended unless supported by two-thirds of the Members present and voting at a Special Meeting called for such purpose or at the Annual General Meeting. Notice of the proposed alteration must be sent out by the Secretary at least seven days before the General or Special Meeting. Any alteration to the rules shall be approved by the High Bailiff and Chief Constable prior to being formally adopted by the Club.
20. COPY OF RULES.
Each new member shall be given a copy of the rules and regulations when their subscription has been paid. All members will be advised of any changes in the rules, proposed at either an Annual General Meeting or Extra-ordinary General Meeting and approved by the High Bailiff and Chief Constable prior to being formally adopted by the Club, in writing by the Secretary.
21. ADMISSION.
Admission to all League and Cup Matches in which the club are involved at the ground shall be as the Committee decides, unless otherwise directed by the Isle of Man Football Association.
22. Any player who refuses to play for any team that he is selected for will be automatically banned from playing for the club until he has appeared in front of the Club Committee.
The Committee, should they find the case proven, shall have the power to suspend the player involved for any period that they consider fair in the circumstances. This suspension may be subject to the right of an appeal, should the player so desire, before an Appeals Committee consisting of three people, at least one of which shall be a Committee member. The Appeals Committee shall have the power to vary the suspension, after deliberating on the merits of the case.
23. LICENSING ACT.
The Hon. Secretary shall make application to the Licensing Court in terms of the Licensing Act 1995 as amended.
No intoxicating liquor shall be sold or supplied to or consumed by any person under the age of 18 years on the Club premises.
24. No drunkenness, bad language, or other misconduct shall be permitted on the Club premises. Any member offending under this rule will be dealt with by the Committee under rule 10 hereof.
25. No guest of the Club shall be permitted to make any payment for intoxicating liquor either directly or indirectly. Should any guest not being a member pay for intoxicating liquor he shall at once be ordered from the club premises and the Member introducing such visitor may be expelled from membership on the facts being duly proved and it shall be the duty of an employee of the Club becoming aware of such breach of rules to report it at once to the Secretary or Committee.
26. The club may be opened daily unless the Committee direct otherwise, from 10.00 a.m. to midnight.
27. GUESTS AND VISITORS.
A member may personally introduce friends to the Club premises as his guests, but no person shall be introduced more than three times within one month and no member may introduce more than three guests at any one time. The guests and the member introducing shall sign their names in a book kept for that purpose. These conditions shall not apply to the introduction by any member of his/her spouse or other partner, the admission of whom shall be subject to such regulations as may from time to time be made by the Committee. Members must accompany their guests during the period of their stay in the club.
The following shall not be permitted as visitors:-
a) Former members who have ceased to be members under Rule 10
b) Any person who for any reason the Club or Committee has
refused to admit to membership. |
